RELEASE OF USERS IN SIGNIFICANT NON-COMPLIANCE The United States Environmental Protection Agency (EPA) has established guidelines that require the Waco Metro Area Regional Sewer System (WMARSS) to release annually, in a newspaper of general circulation that provides meaningful public notice in jurisdictions served by the Public Treatment Works (POTW), a public notice containing a list of industrial users who, at any time during the preceding twelve (12) months, were in significant non-compliance with applicable preprocessing standards and requirements. For purposes of this provision, an industrial user is in material non-compliance if its violation meets one or more of the criteria listed in 40 CFR 403.8(f)(2)(viii) and the approved WMARSS pretreatment program. This notice is intended to inform the public that: Bare Arms Brewing, LLC, located at 2515 LaSalle Avenue, Waco, Texas, 76706, has violated the following provisions: Part E.10 of its Sewer Use Permit by failing to notify changes to facilities. Bare Arms Brewing has been assessed a penalty/cost recovery fee. Part G.3 of its Sewer Use Permit by discharging without permit or approval. Bare Arms Brewing has been assessed penalties/cost recovery fees. Waco Prescriptions Code Section 26-222 by knowingly making false statements, representations or certifications in a report or other document required to determine compliance. Bare Arms Brewing has been assessed a penalty/cost recovery fee. Packaging Corporation of America, located at 9200 Old McGregor Rd., Waco, Texas, 76712, has violated the following provisions: Section 26-213 (c) of the Waco Ordinance Code by failing to notify accidental discharges/cap loadings . Packaging Corporation of America has been assessed penalties/cost recovery fees. Section 26-213(c) of the Waco Prescribing Code by failing to submit a 5-day follow-up report. Waco Ordinances Code Section 26-209(b)(3) by discharging sewage into public sewers that will cause excessive discoloration. Packaging Corporation of America has been assessed penalties/cost recovery fees. Section 26-209(c)(3) of the Waco Code of Ordinance by discharging wastewater into public sewers that may pass into receiving waters without being effectively treated by normal wastewater treatment processes due to the non-ability of the substance to action bacteria. PCA was assessed a penalty/cost recovery fee. Pilgrim’s Pride Corporation, located at 2500 E. Lake Shore Drive, Waco, Texas, 76705, has violated the following provisions: Section 26-213 (c) of the Waco Ordinance Code by failing to prevent accidental discharge/loading of slugs. Pilgrim’s Pride has been assessed a fine/cost recovery fee. Waco Ale Company, LLC., located at 806 Austin, Waco, Texas, 76701, has violated the following: Part B.2 of its Sewer Use Permit by discharging wastewater having a zinc concentration in which 33 % or more of measurements taken in a six-month period exceeded technical review criteria. Part D.1 of its Sewer Use Permit by failing to self-monitor.
